Terms and Conditions

These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. Please read them before placing an order. By placing an order you agree to these terms.

Nothing in these terms reduces your legal rights as a consumer. If any part of these terms conflicts with your statutory rights, your statutory rights prevail.

We trade as English Brands and operate the website english-brands.co.uk.

If we need to contact you, we will do so by telephone, email or post using the details you gave us when ordering.

2. Who these terms apply to

These terms apply to consumers — individuals buying for personal use.

If you are buying as a business (including for resale), sections 6 (Cancellation and returns) and 7 (Faulty goods) do not apply to you, and separate business terms apply. Please contact us before ordering. We may decline any order that appears to be for resale.

You must be at least 18 to place an order. If you are under 18 you may only use the site with the involvement of a parent or guardian.

3. Our products

The images and colours on our website are for illustration only. Although we display them accurately, your device’s screen may not reflect the exact colour or finish of the goods. Small variations in leather grain, shade and texture are inherent to the handmade and natural materials we sell and are not defects.

Sizing guidance on our website is indicative. Fit varies between makers and lasts. If you are unsure, contact us before ordering.

Standard products. Unless a product is expressly identified on its page as a past-season item or as a factory second, it is new, unworn, first-quality stock. This is the great majority of what we sell.

Past-season items. Some products are reduced because the season or collection has ended. These are full-quality goods with no defects, and the ordinary terms of this contract apply to them.

Factory seconds. Some products are sold as “factory seconds”, “seconds” or “sale seconds” at a substantially reduced price. Every item in this category has manufacturing imperfections — that is what the category is, and the lower price reflects it.

These imperfections typically include: scuffs, scratches and machine marks on the upper leather; uneven dye, and differences in shade between the two shoes of a pair or between panels of a garment; irregular stitching, skipped stitches or doubled seams; glue residue, polish marks and blemishes in the finishing; small variations in the seating of the sole, heel or hardware; and damage to the maker’s box where the item itself is sound. The position, combination and prominence of these imperfections vary from item to item.

They are cosmetic. They do not affect how the item performs, how it fits, or how long it will last. We do not inspect, describe or photograph each item in this category individually, and we cannot tell you in advance which of the above a particular item will have. Because these matters are specifically drawn to your attention before you buy, they do not make the goods of unsatisfactory quality under section 9 of the Consumer Rights Act 2015, and we are not liable for them.

Where we are aware that a particular item has a defect affecting how it performs — rather than how it looks — we say so on that item’s page. Any fault that affects performance and was not disclosed to you before purchase is covered in full by section 7 of these terms. Your right to cancel and return under section 6 applies to factory seconds in exactly the same way as to any other product.

4. How the contract is formed

  1.  You place an order through our website. Orders cannot be placed by post.
  2.  We will send you an order acknowledgement by email. This confirms we have received your order; it does not mean we have accepted it.
  3. Our acceptance of your order, and the point at which a contract comes into existence between us, is when we email you to confirm the goods have been dispatched.
  4. If we cannot accept your order we will tell you by email and will not charge you. If we have already taken payment, we will refund it in full.

      We may decline an order where:

  • the goods are unavailable or out of stock;
  • we cannot obtain authorisation for your payment;
  • there has been an error in the price or description of the goods;
  • we suspect the order is fraudulent, or is for resale;
  • we are unable to ship to your delivery address, or doing so would breach export controls, sanctions or other applicable law.


5. Price, payment and delivery

Price. Prices are shown on the product page and include UK VAT where applicable. Delivery charges are shown separately at checkout before you pay. Prices may change, but changes will not affect an order we have already accepted.

Pricing errors. We take care to price our products correctly, but errors occur. If the correct price at the date of your order is higher than the price stated on our site, we will contact you before dispatch for your instructions. If the pricing error is obvious and could reasonably have been recognised by you as a mispricing, we may cancel the order and refund you in full.

Payment. We accept Visa, Mastercard, Maestro, American Express, PayPal, Shop Pay, Apple Pay, Google Pay, Klarna, Diners Club, Discover and UnionPay. Payment is taken at the point of order. Payments are processed by Shopify Payments/Stripe and PayPal; we do not store your full card details.

Currency. Prices on this website are charged in GBP. If your card is denominated in another currency, your card issuer may apply its own exchange rate and charges.

Delivery. Delivery costs and estimated timescales are set out on our Delivery page. Delivery estimates are estimates only and are not guaranteed. We will deliver within 30 days of the contract unless we agree otherwise with you.

Risk and ownership. The goods are our responsibility until they are delivered to you or to a person you have identified to receive them. Ownership passes to you when we receive payment in full.

If nobody is available. If no one is available at your address, the carrier will leave a note and hold the goods for collection or attempt redelivery. If you instruct the carrier to leave goods in a specified place (for example, a porch or with a neighbour), you accept the risk of loss or damage from that point.

Delays outside our control. If delivery is delayed by an event outside our control, we will
tell you as soon as possible and take steps to minimise the delay. If the delay is substantial
you may cancel and receive a refund for goods not delivered.

International orders, duties and taxes. For deliveries outside the United Kingdom:

  • Where checkout states that duties and import taxes are prepaid (DDP), the amount
    shown at checkout is the total payable and no further charges are due on delivery.
  • Where checkout states duties are not prepaid (DAP), you are the importer of record
    and are responsible for any customs duties, import VAT and clearance fees levied by the destination country. These are not within our control and are not included in our prices.
  • You are responsible for ensuring the goods may lawfully be imported into the destination country.

6. Cancellation and returns

6.1 Your legal right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges)
Regulations 2013, if you are a consumer you have the right to cancel your order without
giving a reason.

  • The cancellation period ends 14 days after the day on which you (or a person you nominate) receive the goods. Where an order is delivered in several consignments, the period ends 14 days after the day you receive the last item.
  • To cancel, simply tell us clearly before that period ends. You may email sales@english-brands.co.uk, write to us at the returns address above, or use the model cancellation form at the end of these terms. You do not need our prior authorisation to exercise this right, though letting us know in advance helps us process your refund faster.
  • After telling us you wish to cancel, you must send the goods back to us within 14 days.

6.2 Our additional returns window

In addition to your statutory rights, we will accept returns for exchange for 30 days from  delivery, on the same terms set out below.

6.3 Condition of returned goods

You are entitled to examine and handle the goods as you reasonably would in a shop. Doing so will not affect your right to a refund.

If the value of the goods is reduced because you have handled them beyond what is necessary to establish their nature, characteristics and functioning, we may deduct an amount from your refund reflecting that reduction in value. We will explain any deduction to you, and it will never exceed the price you paid. We will not refuse your refund on these grounds — a deduction is the only remedy available to us.

Please return goods with their original packaging and labels where you still have them, as this helps us resell the item and avoid a deduction.

6.4 How to try items on

The following is guidance, not a condition of return. Following it protects the resale value of the item and means you will receive your refund in full.

Footwear. Try shoes on indoors, on carpet. Please avoid walking further than you need to in order to judge the fit: leather creases permanently across the instep as the shoe flexes, and even a short walk on a hard floor scuffs the sole. Standing and taking a few steps on carpet is normally enough to assess length and width. Wearing footwear outdoors, or for a prolonged period indoors, will reduce its value and is likely to result in a deduction.

Waxed cotton jackets. The wax finish on a new jacket stays soft and picks up anything it touches. Please put the jacket straight back into the bag it arrived in after trying it on, and avoid resting it on sofas, beds, carpets, or hanging it among other clothes. Hair, pet fur, lint and dust bond to fresh wax and cannot be removed without damaging the finish, which reduces the value of the item.

Leather goods and knitwear. Handle with clean, dry hands. Avoid applying fragrance, deodorant or hair products while wearing the item.

6.5 Items that cannot be returned

For hygiene reasons, we cannot accept the return of underwear, socks and other hosiery where a seal or hygiene strip has been broken after delivery. Your statutory rights in respect of faulty goods are unaffected. 

Where goods were sold as a set or multipack, the complete set must be returned.

6.6 Return postage

You are responsible for the cost of returning goods to us, unless the goods are faulty or not as described. We recommend a tracked and insured service, as you bear the risk of loss or damage in transit until the goods reach us.

International returns: same as the above 6.6.

6.7 Your refund

  • We will refund the price you paid for the goods, plus the standard outbound delivery charge you paid. Where you chose an express or upgraded delivery service, we refund the cost of our cheapest standard delivery option only.
  • We refund to the original payment method. We do not charge a fee for refunds.
  • We will refund within 14 days of receiving the goods back, or within 14 days of you
    providing evidence that you have sent them, whichever is earlier. Where you cancel
    before dispatch, we will refund within 14 days of you telling us.
  • Any deduction under section 6.3 will be applied to the refund and explained to you.

6.8 Exchanges

  • We are happy to exchange for a different size or colour subject to availability. We
    send the replacement item to you free of charge within the UK.

7. Faulty, damaged or incorrect goods

Under the Consumer Rights Act 2015, goods we supply must be of satisfactory quality, fit for purpose and as described.

  • Within 30 days of delivery you have the short-term right to reject faulty goods and receive a full refund.
  • After 30 days and within 6 months, you are entitled to a repair or replacement. If that is unsuccessful, or not possible, you may claim a refund or price reduction. During this period, any fault is presumed to have been present at delivery unless we can show otherwise.
  • After 6 months, the same remedies remain available, though you may be asked to show the fault was present at delivery. You may bring a claim for up to six years from delivery (five years from discovery in Scotland).

If goods arrive damaged, incomplete or incorrect, please tell us as soon as you reasonably can, ideally within 48 hours of delivery, and send photographs where relevant. Telling us promptly helps us pursue a claim with the carrier, but it is not a condition of your rights.

Where goods are faulty, not as described or incorrect, we will pay the reasonable cost of returning them to us.

Ordinary wear and tear, damage caused by misuse or accident, failure to follow care instructions, and the natural ageing of leather and waxed cotton are not manufacturing faults. If we and you disagree about whether goods are faulty, we may obtain an independent assessment from the manufacturer; this does not limit your right to pursue the matter further, including through the courts. 

Guarantees offered by manufacturers are in addition to, and do not affect, your legal rights against us.

8. Our website and its content

The website, its design and all content on it are owned by or licensed to EB Online Ltd. You may view the site and print pages for your own personal, non-commercial use. You may not otherwise copy, reproduce, scrape, republish or exploit any part of it without our written consent.

Brand names, trade marks and product images belong to their respective owners and are used to describe the goods we sell. 

You must not misuse our website, including by introducing malicious code, attempting to gain unauthorised access, or placing automated or bulk orders.

We may link to third-party websites. We do not control them and are not responsible for their content or their handling of your data.

9. Our liability to you

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill.

We do not exclude or limit our liability in any way where it would be unlawful to do so, including liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your legal rights in relation to the goods, including the right to receive goods that are as described, of satisfactory quality, fit for purpose and supplied with
    reasonable care and skill;
  • defective products under the Consumer Protection Act 1987.

We are not liable for loss you suffer in the course of a business, including loss of profit, loss of business or business interruption.

10. Changes to these terms

We may change these terms from time to time. The terms that apply to your order are those published on this website at the time you placed it. We will keep a dated version and can provide the version applicable to your order on request.

11. Complaints and dispute resolution

If something has gone wrong, please contact us first at help@english-brands.co.uk. We aim to acknowledge complaints within 2 working days and resolve them within 14 days.

We do not currently participate in any alternative dispute resolution scheme. If we cannot resolve your complaint, you may take the matter to court. You can also obtain free, impartial advice from Citizens Advice on 0808 223 1133 or at citizensadvice.org.uk. If you paid by credit card, or by debit card, you may also have rights against your card issuer.

12. General

  • If a court finds any part of these terms unlawful, the remaining provisions continue in force.
  • If we delay in enforcing these terms, that does not prevent us enforcing them later.
  • We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens and ensure it does not affect your rights.
  • This contract is between you and us. No other person has any right to enforce it.
  • These terms are governed by English law and you may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you live outside the United Kingdom, nothing in these terms deprives you of the protection of any mandatory consumer law of your country of residence.
